1.   Aboutthis Privacy Policy

1.1   Awayco Pty Ltd ACN 617 972 139 (Awayco, we, us or our) has implemented this PrivacyPolicy to provide information about what kinds of Personal Information we maycollect or hold, how we collect, hold, use and disclose that PersonalInformation, choices you have regarding our use of that Personal Information,and your ability to access or correct that Personal Information.  If you are resident in the United Kingdom orthe European Union, we are the controller for the purposes of the EU GeneralData Protection Regulation (EU 2016/679) (GDPR).  If you wish to make any inquiries regardingthis Privacy Policy, you should contact us in any of the ways specified inparagraph 15.

1.2   From time to time, Awayco may berelated to other companies and entities (related entities).  This Privacy Policy applies to the use ofyour Personal Information by us and by those related entities.  Those related entities may also have theirown privacy policies which set out additional detail or differences in theirprivacy practices.  To the extent thatthose privacy policies are inconsistent with this Privacy Policy, those privacypolicies will prevail over this Privacy Policy in relation to the actions ofthose related entities.  A reference inthis Privacy Policy to Awayco, we, us or our is also areference to those related entities.

2.   PersonalInformation

2.1   "Personal Information" is information or an opinion, whethertrue or not, and whether recorded in a material form or not, about an identified individualor an individual who is reasonably identifiable.  If you are resident in the United Kingdom orthe European Union, "Personal Information" includes "personaldata" as defined in the GDPR.

2.2   Although Awayco stores andprocesses Personal Information on behalf of our Business Users as described inparagraph 3.3 below, in general inthis Privacy Policy a reference to "Personal Information" will be areference to the Personal Information we collect about our Business Users andtheir personnel, so that we can register their accounts and otherwise provideand manage our Business Services for them.

3.   WhatPersonal Information do we collect and hold?

3.1   The types of Personal Informationwe may collect about an individual will depend upon the nature of ourinteraction with them.  

3.2   Our "Services" meansthe products and services that are covered by this Privacy Policy. Our"Business Services" are Services provided by Awayco to businessentities ("Business Users").

3.3   Business Users collect PersonalInformation about individuals they interact with in connection with thoseBusiness Users' own business activities. We may process and store suchinformation on behalf of our Business Users in providing our Business Servicesto them, but we do not in the ordinary course of our business directly collectinformation from our Business Users' end customers or suppliers, unless asrequired by law or court/tribunal order.

3.4   Personal Information that wecollect to provide our Business Services may include (but is not limited to)the following, which we generally collect about an owner, operator, applicantor other personnel of a Business User:

        (a) name

        (b) age and/or date of birth

        (c) contact details includingtelephone numbers (landline and/or mobile)

        (d) current and previous address(including shipping address and billing address)

        (e) email address

        (f) information relating toinventory, pricing and customers

        (g) identification information suchas driving licence details, including driving licence number, Business or Taxidentifiers

        (h) payment details, such as yourcredit card or bank account details

        (i) geographical location

        (j) Australian Business Number (ABN)or international equivalents

        (k) photographs and/or images, and

        (l) information from social mediaaccounts and profiles.

3.5   We mayalso collect from individuals who apply for employment with Awayco:

        (a) occupation and employment detailsincluding employment status and history, and

        (b) information from or in connectionwith your resume or job application.

3.6   In thisPrivacy Policy: "You" willgenerally mean a Business User, or a representative of a Business User, but maymean another individual interacting with us depending on the context of theinteraction; and a "Business User",as outlined at paragraph 3.2, isan entity that uses our SaaS Platform in the operation of its business whichmay include in support of the provision of its own products and services to itsend customers.

3.7   In addition to the above, we alsocollect and record Personal Information about individuals such as:

        (a) our customers, potentialcustomers and their representatives

        (b) customers who use your serviceson our platform

        (c) our suppliers and potentialsuppliers and their representatives, directors, partners, proprietors andshareholders

        (d) contractors and subcontractorsand potential contractors and subcontractors and their representatives inrelation to providing goods and services to us

        (e) our employees past and present,including applicants, and

        (f) any other person who comes intocontact with Awayco.

3.8   BusinessUsers may themselves collect Personal Information of their end customers andsuppliers as part of their interaction with those end customers, separatelyfrom Awayco's collection and use in the provision of its Services. ThoseBusiness Users' end customers must review the relevant Business User's ownprivacy policy and data collection notices to understand its PersonalInformation handling practices. We are not responsible for the collection anduse of Personal Information by Business Users.

3.9   If you are resident in Australia,we are authorised to collect tax file numbers (TFNs) by the Income TaxAssessment Act 1936 (Cth).  It is notcompulsory for you to provide your TFN for our products and services, but ifyou do not, taxation law may require additional deductions to be made from amountspayable to you.  

4.   How andwhen do we collect Personal Information?

4.1   We collect your PersonalInformation to allow us to conduct our business functions, to provide, marketand sell our products and services (generally to Business Users) and for thespecified purposes set out in paragraph 6. In some circumstances the collection of Personal Information may berequired by law.

4.2   We may collect your PersonalInformation in the course of providing our Services to Business Users, or:

        (a) when you use or buy our productsor services

        (b) when you provide information tous in any way

        (c) when you request informationabout us, our products or our services

        (d) when you provide feedback to usor a testimonial in connection with our services

        (e) when you visit or fill in a formon our Website (see paragraph 5)

        (f) when you register for or use anaccount on our Website

        (g) when you visit premises fromwhich we operate

        (h) when you (or your employer)provide that information to us in the course of conducting or administering ourrelationship with you, or when you are carrying out activities in connectionwith our business operations

        (i) when you submit a job applicationto us

        (j) when you otherwise contact us bytelephone, fax, email, social media, post or in person, or

        (k) where we are otherwise requiredor authorised by law to do so.

4.3   Generally, when providing ourproducts and services, dealing with our personnel, or obtaining goods andservices from our service providers, suppliers or contractors, we collect PersonalInformation directly from the relevant individual where reasonable andpracticable (and except in respect of the end customers or suppliers of ourBusiness Users, which we receive from our Business Users and store and processonly on their behalf, as explained in this Privacy Policy).

4.4    We may also collect PersonalInformation about you from third parties and other sources such as:

        (a) your nominated representatives(eg an authorised individual on behalf of other personnel for a Business User,spouse, accountant, power of attorney, brokers and other professional advisors)

        (b) publicly available sources ofinformation

        (c) for our Business Users - thirdparty accounts you connect to your account such as SSO, payment,  social media, applications and otherintegrations, or

        (d) related entities, companies andbusinesses of Awayco, but we will only collect your Personal Information in this way ifit is unreasonable or impracticable to collect this information directly fromyou or if we are otherwise permitted to do so.

4.5   In general, we do not collect anysensitive information (including Special Categories of Personal Data as definedunder the GDPR) about you (this includes details about your race or ethnicity,religious or philosophical beliefs, sex life, sexual orientation, politicalopinions, trade union membership, information about your health, and geneticand biometric data), unless you provide it directly to us or where we otherwisehave your consent.  Nor do we generallycollect any information about criminal convictions and offences, except whereyou provide it to us or we otherwise have your consent.

4.6   Where we engage with you multipletimes over a short period in relation to the same matter, we may not provideyou with a separate notice about privacy each time we engage with you.

4.7   If you choose not to provide yourPersonal Information to us for the purposes set out in this Privacy Policy, orif we do not or are unable to collect the Personal Information we require, wemay not be able to provide you with the requested information, products orservices, or to effectively conduct our relationship with you.  

5.   Informationcollected via our Website

5.1   Personal Information may becollected by us and by our third party service providers who assist us inoperating our website at www.awayco.com including itssubdomains and any other website we operate from time to time (collectively,the Website).

5.2   We may use various technologicalmethods from time to time to track the visiting patterns of individualsaccessing our Website, including but not limited to the methods set out in thisparagraph 5.

Google Analytics

5.3   We use Google Analytics to helpanalyse how you use our Website.  GoogleAnalytics generates statistical and other information about website use bymeans of cookies, which are stored on users' computers.  The information generated is used to createreports about the use of our Website. Third party content(eg social media links)

5.9   Some of the content on ourWebsite may include applications made available by third parties, such associal media buttons or links that allow you to share content or links to ourWebsite through the relevant third party platforms.  These third party applications themselves mayfacilitate collection of information by those third parties, through yourinteraction with the applications and sometimes even if you do not interactdirectly with them.  We are notresponsible for the technical operation of these applications or the collectionand use practices of the relevant third parties.  Please visit the relevant third partywebsites to understand their privacy practices and options they may makeavailable to you in relation to their collection of your Personal Information.

6.   How dowe use your Personal Information?

6.1   We use the Personal Informationwe collect about you for our business functions and activities, to provide ourServices to our Business Users, in order to operate our business efficiently,and to market our products and services for the benefit of our customers.

6.2   We may collect, hold and use yourPersonal Information:

        (a) where we need to perform thecontract we are about to enter into or have entered into with you

        (b) where it is necessary for our legitimateinterests (or those of a third party) and your interests and fundamental rightsdo not override those interests

        (c) to identify and communicate withyou

        (d) to enable us to provide you withrequested information, products or services

        (e) to process any rental ordersthrough our Website

        (f) to otherwise assist customers byproviding them with information and support

        (g) to collect and process payments

6.3   We may aggregate PersonalInformation for reporting, statistical and analysis purposes, and for business,product and service improvement purposes. This allows us to better inform ourselves and anticipate our customers'preferences and requirements, and to monitor and improve the effectiveness ofour business, products and services.  Wemay also de-identify information for inclusion in such aggregated databases orreports.

6.4   We reserve the right at all timesto monitor, review, retain, and/or disclose any information as necessary tosatisfy any applicable law, but we have no obligation to monitor the use of theWebsite or to retain the content of any user session.

6.5   If you are resident in the UnitedKingdom or European Union, we generally do not rely on consent as a legal basisfor processing your Personal Information, although we will get your consentbefore sending third party direct marketing communications to you via email ortext message.  You have the right towithdraw consent to marketing at any time by contacting us in the waysspecified in paragraph 15 of this Privacy Policy.

6.6   You consent to us using yourPersonal Information in the above ways and as set out in this Privacy Policy.

6.7   We may otherwise collect, use ordisclose your Personal Information where the collection, use or disclosure is:

(a) in accordance with this PrivacyPolicy or any agreement you enter into with us, or

(b) required or authorised by law,including without limitation the Australian Privacy Principles under the Privacy Act 1988 (Cth).

6.8   If you are resident in the UnitedKingdom or the European Union, we have set out in the table below a descriptionof the ways we plan to use your Personal Information, and which of the legalbases we rely on to do so. We have also identified what our legitimateinterests are where appropriate.

7.   When dowe disclose your Personal Information?

7.1   Awayco may disclose, or provide access to, your Personal Information tothird parties in connection with the purposes described in paragraph 6.  Depending on the circumstances and the natureof your engagement with us, we may disclose your Personal Information to ourrelated entities, to third parties that provide products and services to us orthrough us, or to other third parties (such as your referee(s) in connectionwith a job application you have submitted).

Disclosure to rentalservice partners

7.2   When using our rental services,Awayco aims to ensure that you have a seamless booking experience andprofessional customer service at Awayco's rental partners and accounts.

7.3   When you submit a request to bookor purchase products on our platform, your Personal Information including yourfull name, email, telephone number, profile preferences and booking informationwill be made available to the partner or account with whom you have made thebooking. This is necessary for the partner or account to identify you and provideyou with an appropriate level of service to ensure your booking is a smoothexperience.

7.4   By submitting a request to bookgear on Awayco you agree for Awayco to disclose this information with thepartner or account with whom you have booked. We may also disclose parts ofyour public profile; and any additional information you share with other users.You may be contacted by the partner or account by chat, email or phone. We willnot disclose this information unless there is a confirmed booking.

7.5   Your billing and payoutinformation is processed by our third party service provider, Stripe, where itis authenticated, encrypted on disk with AES-256 and stored on secure andseparate hosting infrastructure.

7.6   When you use a partner oraccount’s products, we may ask you to review the products, or the partner oraccount. If you choose to provide a review, your review may be public on theWebsite.

Other disclosures

7.7   We may also disclose yourPersonal Information to:

(a) any of Awayco's internaldivisions, business units or departments

(b) your nominated representatives

(c) other organisations orindividuals who may assist us in providing products and services to you

(d) professional service providersand advisors who perform functions on our behalf, such as lawyers

(e) representatives, agents orcontractors who are appointed by us in the ordinary operation of our businessto assist us in providing goods or services or administering our business (suchas for data storage or processing, printing, mailing, marketing, planning andproduct or service development)

(f) banks, lenders, valuers,insurers, brokers, auditors, business consultants and IT service providers, and

(g) Government, regulatoryauthorities and other organisations as required or authorised by law.

7.8   The Website allows your publicprofile to be included in search engines, in which case your public profile andpublic pages will be indexed by search engines and may be published as searchresults. This option is enabled by default. We do not control the practices ofthird party search engines, and they may use caches containing outdatedinformation. We may distribute parts of the Website for display on sitesoperated by Awayco’s business partners and partners or accounts. Informationfrom your public profile page may also be displayed.

7.9   We may also disclose yourPersonal Information to our Website host or software application providers incertain limited circumstances, for example when our Website experiences atechnical problem or to ensure that it operates in an effective and securemanner.

7.10   We often receive testimonials andcomments from partners, accounts and/or users who have had positive experienceswith our services. We may post user feedback on our Website from time to time.We will share your feedback with your first name and last initial only. If wechoose to post your first and last name along with your feedback, we willobtain your consent prior to posting your name with your feedback. If you makeany comments on a blog or forum associated with the Website, you should beaware that any Personal Information you submit there can be read, collected, orused by other users of these forums, and could be used to send you unsolicitedmessages. We are not responsible for the personal information you choose tosubmit in these blogs and forums.

7.11   As we continue to develop ourbusiness, we may buy, merge or partner with other companies or organisations,and in so doing, acquire customer Personal Information.  In such transactions, Personal Informationmay be among the transferred assets. Similarly, in the event that a portion or substantially all of ourbusiness or assets are sold or transferred to a third party, we may alsodisclose certain information including your Personal Information to a purchaseror potential purchaser in connection with the sale or potential sale of us, ourbusiness or any of our assets, including in insolvency.

8.   Interstateand Overseas disclosures

8.1   Some of your Personal Informationmay be disclosed, transferred, stored, processed or used overseas by us, or bythird party service providers.  This mayhappen if:

(a) our offices or related entitiesare overseas

(b) we outsource certain activitiesoverseas

(c) transactions, information,services or products have an overseas connection, or

(d) our computer systems including ITservers are located overseas.  

8.2   You consent to the collection,use, storage, and processing of your Personal Information outside of thecountry you reside in as set out in this Privacy Policy.  

8.3   In particular, your PersonalInformation may be disclosed to our organisation and to third parties inAustralia, the United States of America, and such other countries in whichthose parties or their, or our, computer systems may be located from time totime, where it may be used for the purposes described in this PrivacyPolicy.    

8.4   If you are resident in Australia,in these circumstances, you consent to the collection, use, storage andprocessing of your Personal Information in the countries (other than Australia)listed above, without us being responsible under the Privacy Act 1988 (Cth) for such use (or for any breach). Where suchparties are located overseas, you may have rights to enforce such parties'compliance with applicable data protection laws, but you might not have recourseagainst those parties under the Australian Privacy Act in relation to how thoseparties treat your Personal Information.

8.5   If you are resident in the UnitedKingdom or the European Union, whenever we transfer your Personal Informationout of your resident country, we ensure a similar degree of protection isafforded to it by ensuring that where we use certain service providers, we willuse specific contracts approved by the European Commission which gives PersonalInformation the same protection it has in Europe.

9.   Otheruses and disclosures

9.1   We may collect, use and discloseyour Personal Information for other purposes not listed in this PrivacyPolicy.  If we do so, we will make itknown to you at the time we collect or use your Personal Information.  

10.   Marketing

10.1   Awaycodoes not undertake direct marketing to or about our Business Users' endcustomers or suppliers. For all other individuals (for example our BusinessUsers' directors, business owners or other Business User representatives who wedeal with in the course of providing our Services to those End Users), thisparagraph 10 sets out how we may use your personal information for directmarketing activities.

10.2   If you are resident in the UnitedKingdom or European Union (and elsewhere if required by law), we will get yourexpress opt-in consent before we share your Personal Information with any thirdparty for marketing purposes.

10.3   In all other cases, you consentto us using your Personal Information for sending you information, includingpromotional material, about us or our products and services, as well as theproducts and services of our related entities and third parties, now and in thefuture.  You also consent to us sendingyou such information by means of direct mail, email, SMS and MMS messages.  

10.4   If you do not want to receivemarketing information from us, you can unsubscribe in any of the followingways:

        (a) clicking on the 'Unsubscribe' orsubscription preferences link in a direct marketing email that you havereceived from us

        (b) logging into your account on theWebsite and editing your communication preferences, or

        (c) contacting us using the contactdetails specified in paragraph 15.

11.   Storageand security of Personal Information held by us

11.1   We aim to keep your PersonalInformation secure.  Any PersonalInformation that is collected via our Website or which is held on our computersystems is protected by safeguards including physical, technical (firewalls,SSL encryption etc) and procedural methods.

11.2   If we find that we no longerrequire or have no further need for your Personal Information we mayde-identify it or remove it from our systems and destroy all record of it.  

12.   Yourlegal rights

12.1   If you are based in the UnitedKingdom or the European Union, under certain circumstances, you have rightsunder data protection laws in relation to your Personal Information to:

        (a) Requestaccessto your Personal Information (commonly known as a “data subject accessrequest”). This enables you to receive a copy of the Personal Information wehold about you and to check that we are lawfully processing it.

        (b) Requestcorrection of the Personal Information that we hold about you. This enablesyou to have any incomplete or inaccurate information we hold about youcorrected, though we may need to verify the accuracy of the new information youprovide to us.

        (c) Requesterasureof your Personal Information. This enables you to ask us to delete or removePersonal Information where there is no good reason for us to continue toprocess it. You also have the right to ask us to delete or remove your PersonalInformation where you have successfully exercised your right to object toprocessing (see below), where we may have processed your information unlawfullyor where we are required to erase your Personal Information to comply withlocal law. Note, however, that we may not always be able to comply with yourrequest of erasure for specific legal reasons which will be notified to you, ifapplicable, at the time of your request.

        (d) Objectto processing of your Personal Information where we are relying on a legitimateinterest (or those of a third party) and there is something about yourparticular situation which makes you want to object to processing on thisground as you feel it impacts on your fundamental rights and freedoms. You alsohave the right to object where we are processing your Personal Information fordirect marketing purposes. In some cases, we may demonstrate that we havecompelling legitimate grounds to process your information which override yourrights and freedoms.

        (e) Requestrestriction of processing of your Personal Information. This enables you to ask usto suspend the processing of your Personal Information in the followingscenarios:

                (i) if you want us to establish theinformation’s accuracy

                (ii) where our use of the informationis unlawful but you do not want us to erase it

                (iii) where you need us to hold theinformation even if we no longer require it as you need it to establish,exercise or defend legal claims, and

                (iv) where you have objected to ouruse of your information but we need to verify whether we have overridinglegitimate grounds to use it.

        (f) Requestthe transfer of your Personal Information to you or a third party. We willprovide to you, or a third party you have chosen, your Personal Information ina structured, commonly used, machine-readable format. If we refuse your request to access your Personal Information, we willprovide you with reasons for the refusal where we are required by law to givethose reasons.  If you are an endcustomer or supplier of one of our Business Users, we may refer your request tothe relevant Business User, as they will generally be in a more appropriateposition to respond to your requests about the data they store or processthrough Awayco's Services than we are.

12.3   For our Business Users, you canaccess and correct some of your Personal Information through the Website bylogging into your account and updating or editing your profile at anytime.  A request for access can otherwisebe made by contacting us in any of the ways specified in paragraph 15.

12.4   We take all reasonable steps toensure that any Personal Information we collect and use is accurate, completeand up-to-date.  To assist us in this,you need to provide true, accurate, current and complete information aboutyourself as requested, and properly update the information provided to us tokeep it true, accurate, current and complete.
